PRIVACY POLICY

1. DEFINITIONS
For purposes of this Privacy Policy:
- “Company” refers to CAD2CODE LLC.
- “Client” refers to any individual or entity engaging Company services.
- “Personal Information” means any information that identifies or can reasonably be used to identify an individual.
- “Technical Data” includes, but is not limited to, CAD files, CAM programs, toolpaths, setup sheets, process documentation, machining strategies, and any related manufacturing data.
- “Controlled Data” means any Technical Data subject to the International Traffic in Arms Regulations (ITAR), Export Administration Regulations (EAR), or other applicable export control laws.
- “Services” means CAM programming, CNC process development, setup sheet creation, manufacturing consulting, and related services.
2. SCOPE AND APPLICABILITY
This Privacy Policy applies to:
- All users of the Company’s website
- All Clients engaging the Company for Services
- All data collected online or offline in connection with Services
This Privacy Policy is governed by and construed under the laws of the State of Texas and applicable federal laws of the United States.
3. INFORMATION COLLECTION
3.1 Personal Information
The Company may collect:
- Full name, employer, and job title
- Contact details, including email, phone number, and address
- Billing and payment information
3.2 Technical and Proprietary Information
The Company may collect and process:
- CAD/CAM files and associated metadata
- CNC programs, toolpaths, and post-processed code
- Setup sheets, tooling lists, workholding strategies
- Process documentation and manufacturing methodologies
- Information disclosed during consultation, including operational workflows, production constraints, and proprietary know-how
3.3 Automatically Collected Data
The Company may automatically collect:
- IP address and device identifiers
- Browser and operating system data
- Website usage metrics and analytics
- Cookies and similar tracking technologies
3.4 Controlled Data
Clients may submit Controlled Data only through secure systems. The Company does not independently classify Client data and relies on Client disclosures regarding export control status.
4. USE OF INFORMATION
The Company processes information strictly for legitimate business purposes, including:
- Performance and delivery of Services
- Development of CNC programs, setup sheets, and process documentation
- Provision of technical consultation and process optimization
- Internal quality control and service improvement
- Compliance with legal, regulatory, and contractual obligations
- Enforcement of agreements and protection of Company rights
Under no circumstances will Client Technical Data be used for competitive purposes or reverse engineered for unauthorized reuse.
5. CONFIDENTIALITY AND INTELLECTUAL PROPERTY PROTECTION
5.1 Confidential Treatment
All Technical Data provided by Clients shall be treated as Confidential Information, whether or not marked as confidential.
5.2 Non-Use and Non-Disclosure
The Company shall:
- Use Client Technical Data solely for the purpose of delivering Services
- Not disclose such data to third parties without prior written consent, except as required by law
- Not replicate, distribute, or commercialize Client-specific processes or methodologies
5.3 Process and Consultation Safeguards
The Company expressly acknowledges that:
- Setup sheets, process plans, and machining strategies constitute proprietary intellectual property
- Consultation discussions may involve trade secrets and confidential operational knowledge
Such information shall not be:
- Reused for other clients in identifiable or substantially similar form
- Incorporated into internal libraries in a manner that compromises Client confidentiality
5.4 Residual Knowledge
Notwithstanding the foregoing, the Company retains the right to use general knowledge, skills, and experience acquired during performance of Services, provided such use does not result in disclosure of Client-specific Confidential Information.
6. ITAR AND EXPORT CONTROL COMPLIANCE
The Company complies with:
- International Traffic in Arms Regulations (ITAR) (22 CFR Parts 120–130)
- Export Administration Regulations (EAR) (15 CFR Parts 730–774)
The Company shall:
- Restrict access to Controlled Data to authorized U.S. persons unless proper authorization is obtained
- Implement administrative, technical, and physical safeguards to prevent unauthorized export or disclosure
- Refuse or suspend Services where compliance cannot be ensured
Clients represent and warrant that:
- They will identify any Controlled Data prior to transmission
- They have authority to share such data with the Company
The Company disclaims liability arising from Client failure to properly designate Controlled Data.
7. DATA SHARING AND DISCLOSURE
The Company does not sell, rent, or trade Personal Information or Technical Data.
Disclosure is limited to:
- Authorized service providers under binding confidentiality and data protection obligations
- Legal authorities when required by law, subpoena, or court order
- Successors in the event of merger, acquisition, or asset sale, subject to equivalent protections
Under no circumstances will Controlled Data be disclosed in violation of U.S. export laws.
8. DATA SECURITY
The Company implements commercially reasonable safeguards, including:
- Encryption in transit and at rest where applicable
- Access controls based on least-privilege principles
- Secure file transfer protocols
- Monitoring and audit controls
However, the Company makes no warranties regarding absolute security and disclaims liability for unauthorized access beyond its reasonable control.
9. DATA RETENTION
The Company retains data only as long as necessary to:
- Fulfill contractual and operational requirements
- Maintain records of delivered Services, including programs and setup sheets
- Comply with legal and regulatory obligations, including export control recordkeeping
The Company reserves the right to retain anonymized or de-identified data indefinitely.
10. USER RIGHTS
Subject to applicable law, individuals may:
- Request access to Personal Information
- Request correction or deletion
- Object to certain processing activities

The Company reserves the right to deny requests where permitted by law.
11. COOKIES AND TRACKING
The Company uses cookies and similar technologies for:
- Website functionality
- Analytics and performance monitoring
Use of the website constitutes consent to such technologies unless disabled by the user.
12. THIRD-PARTY SERVICES
The Company is not responsible for the practices of third-party websites, platforms, or service providers not under its direct control.
13. DISCLAIMER OF WARRANTIES
All Services and website functionality are provided “as is” and “as available.” The Company disclaims all warranties, express or implied, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
14. LIMITATION OF LIABILITY
To the maximum extent permitted by Texas and U.S. law:
- The Company shall not be liable for indirect, incidental, consequential, or punitive damages
- The Company’s total liability arising from or related to this Privacy Policy shall not exceed the amount paid by the Client for Services giving rise to the claim
15. INDEMNIFICATION
Clients agree to indemnify, defend, and hold harmless CAD2CODE LLC from any claims, damages, or liabilities arising from:
- Client-provided data, including Controlled Data
- Client’s failure to comply with export laws
- Unauthorized or unlawful use of Services
16. CHILDREN’S DATA
The Company does not knowingly collect information from individuals under 13 years of age.
17. GOVERNING LAW AND VENUE
This Privacy Policy shall be governed exclusively by the laws of the State of Texas.
Any legal action shall be brought exclusively in courts located within the State of Texas, and the parties consent to jurisdiction therein.
18. CHANGES TO POLICY
The Company reserves the right to modify this Privacy Policy at any time. Continued use of Services constitutes acceptance of revised terms.
